Brecksville fence height rules
In Brecksville, Ohio, a residential fence can be up to 4 feet tall and has to sit in the side or rear yard, behind the front of the house. Want 5 or 6 feet, or a gate out front? You need a variance from the Board of Zoning Appeals. Since March 9, 2026 the board has heard 10 fence requests and said yes to 7.
What the code says
The height and location rule is Section 1185.03(a) of the city’s Planning and Zoning Code. For a regular (interior) lot:
Fences and walls on interior lots within residential areas may be permitted within one (1) foot of any rear lot line or side lot line to the front building line to a height not to exceed four (4) feet from the existing grade. No fences or walls may extend into the front yard beyond the building setback line.Brecksville Codified Ordinances, Section 1185.03(a)
The city’s own handout puts it more simply: “The maximum permitted height for a fence is 4’. The fence can be located in the side and rear yard (from front wall of house to rear lot line).” Fences are not allowed in the city right-of-way.
- Corner lots are stricter. Where a side or rear yard touches a street, fences are prohibited except a split rail or post and rail fence up to 3 feet (Section 1185.03(b)).
- Fence type matters too. Section 1185.02(a) lists what is allowed in residential areas: chain link, board on board, picket, split rail, post and rail, post and board, paddock, corral, wrought iron, open ornamental and basket weave, plus decorative brick or stone walls. Section 1185.02(d) says anything not on that list “is prohibited.” That is why a solid vinyl privacy fence needs its own variance on top of the height one. The handout marks stockade and solid board fences “not permitted.”
- Pool fences are a separate section. In the July 2026 minutes the board’s motion for a fence around a pool area cites Section 1323.03 and its own 4-foot maximum, and at the June hearing the building official told the board a 6-foot fence is permitted when it sits at least 40 feet from the property line (as recorded in the June 8, 2026 minutes). Ask the building department which section applies to you.

What the board heard from the ones that passed
Counts, not odds. With 10 cases, nothing here predicts yours. But the pattern in the minutes is plain: reasons about safety and about the lot itself carried most often; privacy was split; price lost.
- Safety: made in 7 fence cases, 6 of those approved.
- A dog or other pet: made in 6 fence cases, 4 of those approved.
- Deer and wildlife: made in 3 fence cases, 2 of those approved.
- The lot itself: made in 3 fence cases, 2 of those approved.
- Privacy: made in 4 fence cases, 2 of those approved.
- Cost or durability: made in 1 fence case, 0 of those approved.
Three other things show up in the approvals. A narrower ask (6 feet on one stretch, not the whole yard). A document behind the claim (a vet’s recommendation, photos of the deer). And the homeowner presenting in person; both requests brought by a fence company alone were denied.
How to ask for a taller fence
- Apply through the city’s Citizenserve portal and file one hard copy of the proposal by the deadline before the next meeting.
- Include a site drawing to scale. Anything larger than 11 by 17 goes in as a PDF.
- The fee is $50 for the first variance on a parcel and $15 for each additional one. Height and type are two variances.
- The board meets at 7:30 PM on the first Monday after the first Tuesday of each month, in the City Hall Council Chambers. Come yourself.
- City Council votes on the board’s recommendation the following Tuesday. Then apply for the fence permit.
